Governance professionals in Hong Kong are usually obliged to oversee the compliance matters in Hong Kong and the Mainland, and are well advised to take into account their respective legal specificities and recent development.
Since 2017, China has promulgated the Cybersecurity Law, the Personal Information Protection Law (PIPL) and the Data Security Law, together with a series of implementation regulations and administrative guidance to establish a robust legal framework for data protection.
In July 2022, the Cyberspace Administration of China (“CAC”) released the Measures on Security Assessment for Data Exports that came into effect from September 2022. Stepping into June 2023, CAC provided further guidance for entity in China transferring personal data outbound using Standard Contractual Clauses.
In addition to providing an update on data protection in these two jurisdictions, this seminar will focus on the approach, best practices, use of technology and implications of PIPL on cross-border data transfers.
Boards of directors have a critical role to play in ensuring that their organisations comply with data protection regulations and manage data risks effectively. In this seminar, practical guidance is also provided on how boards can oversee data protection policies and procedures, assess and manage data risks, and ensure that their organizations are prepared to respond to data breaches and other incidents.
