The Government recognised, in relation to Hong Kong’s anti-money laundering and counter-financing of terrorism (AML/CFT) landscape for the trust and company service provider (TCSP) sector, that a substantial number of professionals in the sector are experienced and professional Chartered Secretaries qualified with The Hong Kong Chartered Governance Institute (HKCGI), particularly at the senior management level. In general, these professionals exercise caution to mitigate reputational risks, and contribute towards achieving the high standards in mitigating the money laundering and financing of terrorism (ML/FT) sectoral risks through a good level of professionalism and integrity.
The Government further recognised that in May 2016, HKCGI introduced an AML/CFT Charter for TCSPs, incorporating FATF’s essential AML/CFT measures, to accredit firms which have demonstrated compliance. A professional panel was set up to supervise participants’ compliance. The Charter, which was intended for voluntary adoption by company service providers, was signed by six leading firms in the trade. These AML/CFT Charter subscribers continue to support HKCGI in terms of enhancing the standards and awareness of AML/CFT, including with listed companies in their provision of corporate services to them.
